The Daily Journal Reports on Appeals Court Reinstating $13.1M Verdict in Sex Discrimination and Retaliation Case Involving Two LAPD Officers
The Daily Journal interviewed Partner Matthew McNicholas about the restored $13.1 million verdict, secured in 2023, for two LAPD officers, Stephen Glick and Alfred Garcia, who were discriminated against and retaliated against on the basis of their sex.
A published 2nd District opinion authored by Justice Stephen Goorvitch found that the trial judge, now-retired Superior Court Judge Michael Linfield, improperly reduced emotional distress damages, rejected evidence of future economic losses, and abused his discretion by slashing the jury’s award. The appellate ruling reversed an order granting the City of Los Angeles a new trial against the two officers.
“This decision affirms what the jury understood: Officers Glick and Garcia were treated differently because they are men and suffered significant consequences as a result. The trial court had no basis to impose an arbitrary limit on their damages, or disregard the evidence the jury heard,” McNicholas said to the Daily Journal.
